Yesterday a federal judge issued a nationwide injunction against Department of Labor (DOL) regulations that were finalized in May and to be effective December 1. The regulations would have doubled the salary threshold for employees otherwise exempt from overtime pay due to job duties performed.
It is yet to be determined what steps the DOL will take next. The DOL strongly disagrees with the decision and has the right to appeal. However, the appeal could be dropped since Donald Trump is President-elect and was outspoken against the regulations during his campaign.
Regardless, many companies have been forced to review worker classification policies and if you havent done so in a while, that isnt necessarily a bad thing to do now. Contact your labor and employment attorney if you have questions about application of other aspects of the law.
